These general contracting conditions expressly regulate the relations between JOSE GEADA FERNÁNDEZ, and the users who contract or access the products marketed by it through the web page. www.padelvice.com

- HOW TO PLACE AN ORDER

PRICE. The price of the products will be available at all times to the CLIENT of the website and will be expressed in euros.
In any case, the CUSTOMER, prior to the formalization of the contract, will have access to information on product prices and shipping costs. All products offered through this website include VAT.
The price of the product may be modified unilaterally and at any time by JOSE GEADA FERNANDEZ, proceeding to publish the update of the same in the products and services section of the portal.
The prices in force for each purchase process will be those published at that moment in the section related to it.
- GIFTS
On the occasion of certain promotions, JOSE GEADA FERNANDEZ may give a gift to those customers who make a purchase through this website.
In these cases, in the event that the customer proceeds with the cancellation of the contract, he/she must return the purchased product, in accordance with the following section "Withdrawal." of the present conditions, as well as of the free gift that accompanies the main product.
The gift must be returned in perfect condition, without having been used; otherwise, the value assigned to the gift itself will be discounted according to its market value.
The gift will not be exchanged if the customer is not satisfied with it, since it is a product courtesy of JOSE GEADA FERNANDEZ. In addition, if it is a garment, no size changes will be made on it.
In the event that the customer is previously informed of the gift he/she will receive, JOSE GEADA FERNÁNDEZ reserves the right to substitute it for another of equal or greater value, in the event that, for reasons of stock, it is not available.
- PAYMENT, DELIVERY, PERFORMANCE AND SHIPPING COSTS
PAYMENT AND MEANS OF PAYMENT: prior to the confirmation of the order, the customer will be asked for certain data in order to establish the billing and shipping details of the product which will be processed in accordance with the provisions of the Privacy Policy.
The order will be confirmed by making the payment, which will be made effective through any of the following payment methods MEANS OF PAYMENT admitted:
- Credit/debit card: through Redsys POS.
- Through the platform Stripe.
- By means of Bizum.
- Paypal.
- Pdeferred payment through Klarna Bank ABwhich shall be subject to the conditions established by such entity.
Once payment has been made, the CUSTOMER will receive an e-mail with the order confirmation within 24 hours of receipt of acceptance.
DELIVERYThe territorial scope in which JOSE GEADA FERNANDEZ products will be supplied, covers the whole Peninsula.
The goods contracted by the customer through the portal will be made available to the customer at the place indicated for this purpose.
Such availability will be made available through our transport provider within a maximum period, in general, of 2 days, although, in times of high demand (Christmas, Black Friday...) or due to force majeure, this period could be extended up to a maximum of 14 days. In the latter case, the user will be informed of this through the corresponding legend on the product sheet, being aware at all times of the actual delivery time expected.
All orders are managed by JOSE GEADA FERNANDEZ. However, those that are clearly specified in the legend of the same, the order will be managed by external supplier, which will mean that the delivery time of the same, is, in general, 3 days, being extendable, only in times of high demand or force majeure.
Delivery times include only working days, excluding holidays, both at origin and destination, and weekends.
INVOICE: The invoice will be sent via the e-mail address designated for this purpose by the customer, unless he/she expressly indicates his/her wish to receive it on paper.
SHIPPING COSTS: The delivery of the products will be free of charge in all the Peninsular territory if orders are placed for more than 59 euros. When the amount is less than this amount, shipping costs will be 4.90 euros.
- ORDER CANCELLATION
The order may be cancelled, provided that it has not been shipped, on the same day it was placed, by contacting us at the following e-mail address info@padelvice.com.
If you are not in time to cancel the order, you will be subject to the provisions of the withdrawal section.
- RIGHT OF WITHDRAWAL AND RETURNS OF DEFECTIVE PRODUCTS
WITHDRAWAL
The CUSTOMER shall have the right to withdraw from this contract within 14 calendar days without the need for justification, starting from the day on which the CUSTOMER or a third party indicated by him, other than the carrier, acquires the material possession of the goods.
To exercise the right of withdrawal, you must notify in writing to JOSE GEADA FERNÁNDEZ, at the address Rúa de Julia Minguillón, nº4, 3ºA, 15706, Santiago de Compostela (A Coruña) or to the e-mail address info@padelvice.comThe decision to withdraw from the contract, by means of an unequivocal statement.

To comply with the withdrawal period, it is sufficient that the communication concerning the exercise of this right by the CUSTOMER is sent before the expiration of the corresponding period.
In case of withdrawal by the CLIENT, JOSE GEADA FERNÁNDEZ will proceed with the refund of all payments received, including delivery costs (except for the additional costs resulting from the choice by the CLIENT of a delivery method other than the least expensive ordinary delivery method offered), without undue delay and, in any case, no later than 14 calendar days from the date on which the CLIENT is informed of its decision to withdraw.
Without prejudice to the foregoing, the reimbursement may be withheld until the products have been received, or until proof of return of the products has been provided by the CUSTOMER.
The refund will be made in the same way in which the payment was made.
The direct costs of returning the goods shall be borne by the CUSTOMER who will choose the shipping method he/she deems appropriate, always making sure that the product arrives as delivered.
EXCEPTIONS: The right to withdraw from the contract shall apply exclusively to those products that are returned in the same condition in which they were received by the CUSTOMER. No refund will be made if the product has been used beyond the mere opening of the same, of products that are not in the same condition in which they were delivered or that have suffered any damage.
RETURNS OF DEFECTIVE PRODUCTS
In case of any error or damage at the time of delivery, JOSE GEADA FERNANDEZ must be notified within 24 hours of receipt of the shipment via e-mail: info@padelvice.comfollowing the template below:

In these cases, JOSE GEADA FERNÁNDEZ guarantees the resolution of the problem at no cost to the customer.
- LEGAL WARRANTY
The Law does not provide any specificity for perishable goods, i.e., those that have a very limited period of life, the good or its usefulness disappearing when this period is exhausted or when they are consumed, so that the provisions are applied to the extent permitted by the nature of the good. Therefore, the Law applies both to durable goods and to perishable goods, although in the latter case, the nature of the good itself limits or modulates the application of the Law.
Therefore, unless the nature of the product or its useful life is less, our products are guaranteed for 3 years.
During this period JOSE GEADA FERNANDEZ, will be responsible for any lack of conformity that existed at the time of delivery of the product.
In this sense, if the product does not conform to the contract, in order to bring it into conformity, the user will have the right to choose between repair or replacement, unless one of these two options is impossible or, in comparison with the other corrective measure, involves disproportionate costs for JOSE GEADA FERNANDEZ.
There shall be no liability for lack of conformity which the consumer and user knew or could not reasonably have been unaware of at the time of conclusion of the contract or which have their origin in materials supplied by the consumer and user.
- PARTIAL NULLITY
If any of these terms and conditions, or any of the provisions of a contract are declared null and void by a final decision issued by a competent authority, the remaining terms and conditions shall remain in force, without being affected by such declaration of nullity.
- INTELLECTUAL PROPERTY
This website, as well as the elements that compose it, including, but not limited to, its programming, edition, compilation, design, images, texts and/or graphics, are the property of the person responsible for the website, and are protected by national and international regulations on intellectual and industrial property. The access by the user to the website does not grant any property right over them.
Industrial and Intellectual Property rights may not be used without the express consent of their owner, who reserves the right to take appropriate action in case of infringement thereof, which may constitute a crime under the Criminal Code or result in compensation for damages suffered by the owner in the civil field.
- APPLICABLE LAW AND JURISDICTION
